1. Agreement and scope
These Terms of Service (the "Terms") are a binding agreement between you and ReliaPulse LLC ("ReliaPulse," "we," "us," or "our"). They govern your access to and use of ReliaPulse websites, web applications, progressive web app features, accounts, plans, billing features, notifications, integrations, weather features, device services, customer-support communications, SMS support, bug-reporting features, feedback tools, support, and related software and services (collectively, the "Service").
By creating an account, selecting an acceptance checkbox, purchasing or renewing a paid plan, submitting information through the Service, or using the Service, you agree to these Terms.
Our Privacy Policy explains how we handle personal information. If your account or access is designated as Early Access, the Early Access Agreement also applies and controls if it conflicts with these Terms specifically about Early Access participation.
If you do not agree to the applicable terms, do not create an account, purchase a plan, or use the Service.
Physical ReliaPulse hardware may be sold or distributed under separate purchase, marketplace, warranty, or return terms. Unless expressly stated otherwise, these Terms govern use of the ReliaPulse software and connected services rather than the retail sale of physical hardware.
2. Eligibility and geographic scope
You must be at least 18 years old and located in the United States to create an account or use the Service while the Service remains limited to United States users.
You represent that you can legally enter into this agreement and are not prohibited from using the Service under applicable law.
If you use the Service for a business, employer, household organization, property owner, or other entity, you represent that you are authorized to accept these Terms for that entity. In that case, "you" includes both you and the entity.
The Service is not offered under these standard Terms for government agencies, critical infrastructure operations, regulated safety operations, or other uses that require a dedicated service-level, regulatory, or safety agreement.
3. Accounts and shared locations
- Provide accurate account information and keep it current.
- Use a unique password and protect your account, email account, integration tokens, device tokens, and other credentials.
- You are responsible for activity under your account unless caused by our breach of these Terms or applicable law.
- Location owners and administrators may invite or remove members, assign roles, and manage shared information.
- Members of a shared location or organization may see names, email addresses, roles, assignments, tasks, assets, records, files, and other information shared according to their permissions.
- An organization is responsible for its administrators, members, permissions, connected systems, and instructions about use of the Service.
- You must promptly remove access for people who are no longer authorized to use a shared location or organization.
4. The Service, plans, and feature limits
ReliaPulse may help users organize locations, assets, chores, planned tasks, recurring responsibilities, service history, documents, notifications, device data, weather-triggered tasks, and optional integrations. Some features can create, prioritize, or schedule tasks based on dates, rules, device signals, weather information, or third-party integration data.
The Service may be offered through Free, paid, promotional, Early Access, complimentary, or custom plans. Plans may differ in features, user counts, asset limits, storage, integrations, API access, history, data-retention periods, support, and other entitlements.
Plan descriptions and limits displayed in the Service or at checkout are part of the applicable offering. We may add, modify, reclassify, or discontinue features or plans, subject to applicable law and any billing commitments expressly made for a current paid period.
Access to a feature at no charge, through Early Access, through a promotion, or under a particular plan does not create a permanent right to that feature, price, limit, or classification.
If a plan is downgraded, canceled, expires, or becomes unpaid, some features may become unavailable and shorter storage or retention limits may apply. Where practical, we may provide an opportunity to export information, reduce usage, or restore a qualifying plan before data is removed under the applicable retention settings. You remain responsible for keeping independent copies of records you cannot afford to lose.
5. Your content and instructions
"User Content" includes information, text, records, addresses, task notes, asset details, service history, feedback, bug reports, troubleshooting descriptions, support communications, SMS messages, screenshots, documents, photos, integration settings, device configurations, and other materials you or your authorized members submit to the Service.
You retain any ownership rights you have in User Content.
You give ReliaPulse a nonexclusive, worldwide, royalty-free license to host, copy, process, transmit, display, analyze, reproduce, and otherwise use User Content only as reasonably necessary to:
- provide, operate, secure, maintain, and support the Service;
- perform your requested tasks, integrations, notifications, communications, and automations;
- respond to customer-support communications;
- troubleshoot and investigate reported issues;
- improve the Service;
- comply with law and legitimate recordkeeping obligations; and
- enforce these Terms.
This license ends when content is deleted from active systems, except that:
- content incorporated into aggregated or de-identified information may continue to be used;
- feedback and bug reports are also governed by Section 12;
- backup, security, legal, audit, billing, support, and recordkeeping copies may remain for a reasonable or legally required period; and
- information may be retained as otherwise described in the Privacy Policy.
You represent that you have the rights and permissions needed to submit User Content and connect any property, device, member, broker, account, or third-party service.
Do not submit unnecessary Social Security numbers, full payment-card information, bank credentials, health records, children's information, passwords, authentication tokens, private encryption keys, access-control secrets, or other highly sensitive information.
Bug reports and support requests, including SMS support conversations, should contain only the information reasonably necessary to describe and resolve an issue. You are responsible for removing passwords, tokens, unnecessary personal information, confidential business information, and third-party information that is not needed for the request.
6. Acceptable use
You may use the Service only lawfully and in accordance with these Terms. You must not:
- use the Service for emergency response, life-safety monitoring, fire or gas detection, security dispatch, medical care, hazardous-process control, regulatory compliance, or any use where delayed, missed, duplicated, stale, or incorrect information could foreseeably cause serious injury, death, major property damage, or environmental harm;
- access or monitor property, equipment, accounts, systems, networks, devices, or data without authorization;
- interfere with, overload, probe, scan, bypass, or defeat security or access controls;
- introduce malware or attempt unauthorized access;
- reverse engineer, decompile, copy, scrape, or extract the Service except where applicable law expressly permits;
- use the Service to violate privacy, intellectual-property, consumer-protection, telecommunications, messaging, export-control, sanctions, or other laws;
- submit unlawful, fraudulent, knowingly false, misleading, infringing, abusive, threatening, malicious, or harmful content;
- use bug-reporting, feedback, support, telephone, or SMS features to send spam, advertisements, malware, automated submissions, excessive duplicate messages, harassment, or unrelated content;
- knowingly include another person's sensitive, confidential, or identifying information without authorization or a legitimate need related to use of the Service; or
- resell, sublicense, or provide the Service as a managed, emergency, or safety-critical service without a separate written agreement with ReliaPulse.
Nothing in these Terms prohibits good-faith reports about suspected security vulnerabilities. However, you must not access, alter, destroy, download, disclose, or retain data belonging to another person; disrupt the Service; perform denial-of-service testing; use automated vulnerability scanning without written authorization; or exceed the access reasonably necessary to identify and describe the suspected issue.
7. Integrations, devices, weather, notifications, and communications
The Service may connect to user-selected third-party services or systems, including Home Assistant, MQTT brokers, browser push-notification services, telecommunications and messaging providers, networks, devices, official weather services, payment services, or other integrations.
Those external services and systems may be governed by their own terms and privacy practices. ReliaPulse does not control their availability, accuracy, security, delivery, or continued operation.
You direct us to communicate with integrations and devices you connect. You are responsible for the accuracy and authorization of URLs, tokens, credentials, entities, rules, thresholds, mappings, network settings, and permissions.
Weather features may use addresses, mapped coordinates, forecasts, observations, radar-derived estimates, alerts, stations, and other official data sources. Weather data can be delayed, estimated, stale, geographically imprecise, unavailable, or incorrect. ReliaPulse weather features are for task planning and follow-up, not emergency warning or life-safety notification.
Notifications, task creation, task priority, device status, integration results, schedules, weather triggers, SMS messages, and other automated or communications-related outputs can be delayed, unavailable, incomplete, duplicated, stale, or incorrect. Push notifications may be displayed by your device or browser, including on a lock screen, depending on your settings.
Disconnect integrations and rotate credentials when access is no longer needed or may be compromised.
Customer-support SMS
ReliaPulse may offer SMS text messaging as a customer-support channel.
The current ReliaPulse SMS program is limited to customer support and direct replies related to customer-initiated communications. It is not currently used for advertising, promotional campaigns, marketing broadcasts, mass messaging, or automated ReliaPulse application notifications.
When you initiate an SMS conversation with ReliaPulse, you consent to receive SMS replies from ReliaPulse that are reasonably related to your support request and any necessary follow-up concerning that request.
SMS messages may include support responses, troubleshooting information, requests for additional information, status updates, or other communications reasonably related to the support conversation.
Message frequency varies based on the nature and duration of your support request.
Message and data rates may apply to messages sent to ReliaPulse and messages sent by ReliaPulse. Contact your wireless provider if you have questions about your text or data plan.
You may cancel SMS communications at any time by replying STOP. After receiving a valid STOP request, ReliaPulse or its messaging provider may send a confirmation that you have been unsubscribed. After that confirmation, you will no longer receive SMS messages through that messaging program unless you subsequently provide consent again.
If you later want to resume SMS support after opting out, you may re-establish consent through an available opt-in method or as otherwise instructed by the messaging service.
For SMS assistance, reply HELP or contact ReliaPulse at [email protected].
Wireless carriers are not liable for delayed or undelivered messages.
Consent to receive SMS messages is not a condition of purchasing or using a ReliaPulse product or paid subscription.
ReliaPulse does not sell or share mobile telephone information, SMS opt-in information, or SMS consent with third parties or affiliates for their marketing or promotional purposes. Additional information about our handling of mobile information and SMS consent is available in our Privacy Policy.
ReliaPulse may use telecommunications carriers, messaging providers, including services such as UniFi Talk, and other service providers to send, receive, route, secure, or troubleshoot SMS messages. Their systems may process telephone numbers, message content, delivery information, and related technical information as necessary to provide those services.
SMS delivery is not guaranteed. Messages may be delayed, filtered, blocked, duplicated, or unavailable because of carrier networks, messaging providers, device configuration, network conditions, service outages, spam filtering, regulatory requirements, or other circumstances outside ReliaPulse's control.
Do not use SMS support for emergencies, life-safety matters, urgent security incidents requiring immediate response, or any situation in which delayed or failed delivery could cause injury, significant property damage, or other serious harm.
If ReliaPulse later introduces automated SMS notifications, recurring SMS alerts, promotional messaging, or another materially different SMS program, additional disclosures and consent requirements may apply. ReliaPulse will update applicable terms and opt-in procedures as appropriate before enabling such messaging.
8. Safety decisions and professional services
ReliaPulse does not provide engineering, inspection, construction, electrical, plumbing, HVAC, security, medical, legal, insurance, tax, accounting, or other professional advice.
Service content is organizational information and automation assistance, not a substitute for professional judgment, official warnings, manufacturer instructions, applicable codes, or legally required records.
9. Availability, maintenance, infrastructure, and migrations
The Service depends on software, databases, storage, networks, power, internet connectivity, hosting systems, Cloudflare and other infrastructure, telecommunications and messaging providers, third-party APIs, user devices, and external services.
We may perform planned or emergency maintenance, upgrades, security changes, database work, storage changes, network changes, infrastructure migrations, hosting migrations, domain or routing changes, backup or restoration work, and other operational activities.
These activities may temporarily make some or all of the Service unavailable, read-only, delayed, or degraded.
We may move the Service or User Content between ReliaPulse-operated systems and third-party infrastructure as reasonably necessary to operate, secure, scale, or improve the Service. We will use reasonable care during migrations, but we do not guarantee that migrations, upgrades, or maintenance will be interruption-free.
Unless a separate written service-level agreement expressly states otherwise:
- no uptime percentage is guaranteed;
- no maintenance window, response time, recovery time, or support time is guaranteed;
- brief planned or unplanned outages do not automatically entitle you to a refund or credit; and
- any discretionary credit, refund, or extension we provide as goodwill does not create an ongoing service-level commitment.
We may provide advance notice of planned maintenance when practical, but emergency work may occur without advance notice.
10. Paid plans, billing, automatic renewal, and cancellation
Paid subscriptions
Some features require a paid subscription. The price, billing interval, included features, material limits, renewal terms, and applicable taxes or tax treatment will be shown before you authorize a purchase.
When you select a recurring paid plan, you authorize the applicable billing provider to charge the payment method you provide at the disclosed interval until the subscription is canceled or otherwise ends.
Billing providers and merchant of record
ReliaPulse may use Stripe, Link, or another payment provider to process or manage payments, subscriptions, invoices, refunds, disputes, fraud controls, and related billing functions.
Depending on the checkout configuration, the billing provider may act as a payment processor or as the merchant of record for a transaction. The checkout flow will identify the applicable seller or merchant of record and may present additional payment-provider terms.
Where Stripe or Link acts as merchant of record, its transaction terms govern payment processing, indirect taxes, transaction-level billing support, invoices, refunds, and related merchant-of-record functions to the extent stated at checkout. ReliaPulse remains responsible for providing the ReliaPulse Service and product-level support.
ReliaPulse does not require you to provide your full payment-card number or card security code directly to ReliaPulse. Payment credentials are handled through the applicable payment provider. ReliaPulse may receive and store non-sensitive billing information and identifiers needed to manage your account, as described in the Privacy Policy.
Renewals and price changes
Subscriptions renew automatically at the interval disclosed at purchase unless canceled.
We may change prices for future billing periods. We will provide notice when required by law or when the change is material. Price changes will not be applied retroactively to a completed billing period. Where applicable law requires additional consent before a changed recurring charge, we will request it.
Upgrades and downgrades
You may be able to upgrade or downgrade through the Service or the billing provider's customer portal.
The effective date, proration, credit, charge, feature change, and renewal effect of a plan change will be shown or otherwise disclosed before confirmation where applicable.
An upgrade may take effect immediately. A downgrade may take effect immediately or at the end of the current paid period, depending on the plan and the option shown when you make the change.
Cancellation
You may cancel a recurring subscription through the billing controls made available in ReliaPulse or through the applicable billing provider's customer portal.
Cancellation stops future automatic renewals after the effective cancellation date. Unless otherwise stated at cancellation or required by law, access to paid features generally continues through the end of the already-paid billing period.
We will not require you to contact sales or complete an unnecessarily difficult process solely to stop recurring charges.
Failed or reversed payments
If a payment fails, is reversed, is disputed, or remains unpaid, we or the billing provider may retry collection, request an updated payment method, limit paid features, suspend paid access, or downgrade the account after any applicable grace period.
A payment failure does not erase amounts lawfully owed for a completed billing period.
Refunds and service credits
Except where required by law or expressly stated at purchase, paid subscription charges are generally non-refundable once the applicable paid period has begun.
ReliaPulse or the applicable merchant of record may choose to provide a refund, partial refund, account credit, free service period, or other accommodation. A discretionary accommodation is a goodwill action and does not create a permanent refund policy, uptime guarantee, or service-level obligation.
Taxes
Applicable sales tax, use tax, VAT, GST, or other transaction taxes may be calculated, collected, filed, or remitted by the applicable merchant of record or payment provider where supported. In other circumstances, taxes may be added to the amount charged or may remain your responsibility as disclosed at checkout or required by law.
You remain responsible for taxes arising from your own business, income, purchases, or use of the Service that are not expressly handled by the merchant of record.
11. Product highlights, promotions, and sponsored content
ReliaPulse may display product tips, feature announcements, setup recommendations, plan education, internal promotions, and, where enabled, sponsored content.
Internal product information and paid sponsored content are tracked separately.
Sponsored content will not be intentionally presented as an emergency alert, safety instruction, task completion control, system error, or device-control instruction.
ReliaPulse does not currently use its customer-support SMS program to send sponsored content, advertisements, promotional campaigns, or marketing broadcasts.
If you follow a link to a sponsor, advertiser, marketplace, or other external site, that third party's terms and privacy practices apply. ReliaPulse is not responsible for external products, services, claims, availability, or transactions unless expressly stated otherwise.
The Privacy Policy explains how campaign impressions, clicks, dismissals, eligibility information, mobile information, and SMS consent may be processed.
12. ReliaPulse ownership, feedback, and bug reports
ReliaPulse and its licensors own the Service, including software, firmware, fixes, updates, designs, interfaces, documentation, databases, logos, trademarks, and related intellectual-property rights, excluding User Content.
Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable right to use the Service for your internal personal or organizational purposes.
"Feedback" includes suggestions, ideas, feature requests, improvement requests, Early Access results, bug reports, issue descriptions, reproduction steps, diagnostic observations, proposed solutions, comments, and other information you provide about the Service.
If you submit Feedback, you grant ReliaPulse a perpetual, irrevocable, worldwide, transferable, sublicensable, royalty-free right to use, reproduce, modify, analyze, test, publish, distribute, commercialize, and incorporate that Feedback into the Service or other products and services without restriction, payment, attribution, or additional permission.
This Feedback license does not transfer ownership of separate User Content that is unrelated to the Feedback. It permits ReliaPulse to use the submitted report, description, screenshots, reproduction steps, ideas, and related materials to investigate issues and develop improvements.
ReliaPulse owns the software, fixes, updates, features, documentation, designs, processes, and other improvements it independently develops, even when those improvements address or are informed by Feedback you submitted.
We may:
- combine your report with reports submitted by other users;
- classify, prioritize, assign, archive, close, or reopen a report;
- contact you for clarification or testing;
- attempt to reproduce an issue using information included in the report;
- retain an internal history of the report and its resolution as described in the Privacy Policy; and
- use aggregated or de-identified information from reports to analyze recurring issues and improve the Service.
Submitting Feedback, a bug report, or a support request does not create an obligation for ReliaPulse to:
- acknowledge or respond to the submission;
- investigate or reproduce the issue;
- provide support;
- correct or resolve the issue;
- provide a workaround;
- release an update;
- disclose internal investigation or development information;
- meet any particular timeline;
- keep a requested feature or fix confidential;
- provide compensation, credit, attribution, or ownership rights; or
- continue offering any affected feature.
13. Suspension, termination, account closure, and data access
You may stop using the Service at any time. You may cancel a paid subscription as described in Section 10. Contact us to request account closure or deletion where a self-service option is not available.
We may suspend or terminate access, remove content, reject submissions, or limit features if reasonably necessary to:
- protect users or the Service;
- respond to security or legal issues;
- enforce these Terms;
- prevent fraud or abuse;
- address nonpayment; or
- discontinue or materially restructure the Service.
Before stopping use, export or copy information you need using available features. We do not guarantee permanent storage, recovery, or export of User Content.
Following closure, we may retain limited information as described in the Privacy Policy and as required or permitted for billing, taxes, security, legal compliance, dispute resolution, fraud prevention, SMS opt-out compliance, verification of fixes, and legitimate business records.
Cancellation of a subscription and deletion of an account are separate actions. Canceling a subscription does not automatically delete your account or User Content unless the Service expressly says otherwise.
Opting out of SMS and canceling a ReliaPulse subscription are also separate actions. Replying STOP to SMS does not cancel your ReliaPulse account or paid subscription.
14. Third-party services
Third-party services, marketplaces, browsers, operating systems, payment providers, telecommunications carriers, messaging providers, government data services, integrations, and linked sites are not controlled by ReliaPulse.
Your use of them may be governed by separate terms and privacy policies.
ReliaPulse may use third-party telecommunications and messaging services, including UniFi Talk or successor services, to provide telephone and SMS support functionality.
ReliaPulse is not responsible for a third party's availability, data, security, billing practices, content, message delivery, filtering, or performance except to the extent applicable law provides otherwise.
15. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." RELIAPULSE DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR MEET YOUR REQUIREMENTS.
We do not warrant any alert, task, schedule, weather result, device reading, integration result, maintenance or service record, notification, SMS message, support communication, campaign recommendation, bug-report response, correction, workaround, update, migration, backup, restoration, or other output.
We do not guarantee that every reported issue will be identified, reproduced, corrected, or prevented from recurring.
We do not guarantee that any email, push notification, telephone call, or SMS message will be delivered, delivered on time, received, read, or acted upon.
Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.
16. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RELIAPULSE AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, USE, GOODWILL, OR BUSINESS OPPORTUNITY; OR PROPERTY DAMAGE, PERSONAL INJURY, OR COSTS ARISING FROM RELIANCE ON ALERTS, TASKS, WEATHER DATA, DEVICE DATA, INTEGRATIONS, NOTIFICATIONS, SMS MESSAGES, SUPPORT COMMUNICATIONS, BUG-REPORT RESPONSES, OR SERVICE AVAILABILITY, EVEN IF ADVISED OF THE POSSIBILITY.
To the maximum extent permitted by law, ReliaPulse's total liability arising out of or relating to the Service or these Terms will not exceed the greater of:
- the amount you paid ReliaPulse for the Service during the 12 months before the event giving rise to the claim; or
- $100.
If a payment provider is the merchant of record, amounts paid through that provider for the ReliaPulse Service during the applicable period will be treated as amounts paid for the Service solely for purposes of this liability cap.
These limits do not apply to liability that cannot legally be limited.
17. Indemnification
To the extent permitted by law, if you use the Service for an organization or commercial purpose, you will defend, indemnify, and hold harmless ReliaPulse and its members, officers, employees, and contractors from third-party claims, damages, losses, and reasonable legal costs arising from your User Content, unauthorized or unlawful use, connected systems or devices, violation of these Terms, or infringement of another person's rights.
This section does not require a consumer to indemnify ReliaPulse where prohibited by applicable law.
18. Governing law and disputes
These Terms are governed by Tennessee law, without regard to conflict-of-law principles, except that applicable federal law controls where required.
Before filing a claim, each party will make a good-faith effort for 30 days to resolve the dispute informally after written notice.
Any court proceeding must be brought in the state courts located in Wilson County, Tennessee, or the federal courts having jurisdiction over Wilson County, unless applicable consumer law requires another forum.
19. Changes and general terms
We may update these Terms as the Service, plans, billing model, infrastructure, communications services, messaging programs, or legal requirements change.
We will post the updated version and effective date and, when changes are material, provide reasonable notice through the Service or email. If applicable law or our legal-acceptance system requires renewed consent, we will ask you to accept the updated Terms before continued use.
If ReliaPulse materially expands its SMS program, including by introducing automated application notifications, recurring SMS alerts, promotional SMS, or other messaging not covered by the current customer-support program, we may update these Terms and applicable consent procedures before enabling the new messaging use case.
These Terms, the Privacy Policy, and any applicable Early Access Agreement are the entire agreement about the Service unless we sign a separate written agreement.
If a provision is unenforceable, it will be modified only as needed and the remainder stays effective.
Our failure to enforce a provision is not a waiver.
You may not assign these Terms without our written consent. We may assign them in connection with a reorganization, financing, merger, acquisition, or sale of assets.
